The Aviation Services Law of 2012 codifies and harmonizes international conventions in the tourism sector. These conventions held sway for many years, but lacking consistent national legislation, states—including Israel—applied them inconsistently. Considering filing an aviation claim? After extensive deliberation, in 2012, MK Ahmad Tibi proposed and passed the Aviation Services Law, addressing gaps in airline liabilities and passenger rights. The Aviation Services Law applies to all flights entering and departing from Israel, including stopovers.

Exemplary damages, as the name suggests, require only proof of an airline’s breach of duty. The claimant need not demonstrate actual harm resulting from the breach. However, courts assess the harm suffered based on their experience and judgment to determine compensation. While detailing damages in the claim (such as non-pecuniary harm like distress) is beneficial, and supporting evidence is advisable, it is not mandatory.
