Where is the small claims complaint filed?

Small claims actions are filed in a Small Claims Court located within the judicial district meeting one or more of the following criteria:

1. The defendant’s place of residence;
2. The defendant’s place of business;
3. The location where the act or omission giving rise to the claim occurred;
4. In claims relating to internet commerce or publication (e.g., online purchases or online defamation), the action may also be filed in the plaintiff’s place of residence or business;
5. In the case of a counterclaim, it must be filed in the same court as the original claim.

For example: A traffic accident occurred in Netanya, and the defendant insurance company is located in Ashkelon. The claim may be filed in any Small Claims Court in the Central District (as Netanya, within the Central District, is the location of the act giving rise to the claim), or in any Small Claims Court in the Southern District (as Ashkelon is located in the Southern District and is the defendant’s place of business).
