The Judiciary’s Form:
By law, a small claims lawsuit must be initiated using a small claims form prepared by the judiciary. This is a completely free form available for download online, and the only expense involved is the statutory filing fee.
The form is available in PDF format (i.e., non-editable). Therefore, the claimant must print the form, fill it out by hand, and attach documents. However, beyond the fact that this method is outdated (and also produces a less aesthetically pleasing result), the fill-in boxes on the form are generic and often do not allow for an adequate description of the case. For example:
In the section “Description of the Claim,” the claimant is first asked to describe the place and date on which “the obligation for payment of the claimed sum of money was created, either by agreement between the parties or otherwise.”
Needless to say, this box is irrelevant to most small claims lawsuits. What does one write in this box when it is a spam claim? Or an airline claim? Or a claim for a traffic accident?
The point is clear. Most of the boxes on the form are similarly difficult to fill with details that correspond to the case in question. As a result, claimants may become entangled and describe their simple case in a convoluted way that does not accurately reflect their claims.
Furthermore, it is unnecessary to explain that submitting printed forms filled out by hand is an outdated approach. It is clear to everyone that it is preferable and desirable to prepare a printed and organized document prepared on a computer or mobile phone.
Small Claims Lawyer
Another option, of course, is to use a small claims lawyer. However, many cases are very simple and the amounts involved are small, making it less cost-effective; and sometimes unnecessary. This is because the claimant understands their case and can describe it quite easily.
Let us clarify: Of course, if a claimant has difficulty understanding their case or if the claim amount is high, it would be advisable to at least consult with a lawyer who understands the issue. However, one way or another, although this is a not bad option at all, it is certainly expensive relative to the average amount of small claims filed annually.
This is particularly true when there is no guarantee that the amount paid to the lawyer will be reimbursed to the claimant as “legal costs.” Therefore, many claimants forgo this option simply due to the financial concerns, and lacking a suitable alternative – waive their rights. And let us recall that by law, it is forbidden to be represented by a lawyer in small claims proceedings, unless special permission is granted (granted in only about 1% of claims and in exceptionally unusual cases).
Additional Options
There are websites that offer one of two options: 1. To prepare the court form online; 2. Or to describe the case and a lawyer will prepare the statement of claim.
The first option does not help overcome the inherent deficiencies in the small claims court form, as explained above. And the second option, although it appears different, is essentially the same thing. In other words, it is still a professional who will prepare the statement of claim, and the cost will presumably be accordingly. Perhaps slightly lower than if a client contacts a lawyer directly on their own initiative, but still not cheap and certainly not free.
