According to the guidelines of the judiciary, if the defendant is a private individual, it is not necessary to include their identity document number in the writ of summons.

However, practice in court registries indicates that a physical filing of the writ of summons is not possible without the defendant’s identity document number. This is particularly true when the defendant has a common name (such as John Smith), which may lead to misidentification.
