Can a small claims action be filed for failure to repair defects in an apartment?

Yes, provided the claim amount does not exceed NIS 37,700 (the small claims court limit as of January 2023).

Both parties to the lease (landlord and tenant) may file such claims. Landlords may, for instance, seek reimbursement for expenses incurred in repairing defects that were the tenant’s responsibility, along with additional damages.
