Apartment Rental Repairs: Liability and Governing Laws

Notice: This article addresses only rental agreements subject to the Fair Rental Law. Before proceeding, please review the list of rentals excluded from the law’s application.

Section 25(h) of the Rental and Loan Law stipulates that the tenant is responsible for repairing any defect/damage to the apartment if both of the following conditions are met:

The defect/damage resulted from unreasonable use of the apartment;
The rental agreement does not specify otherwise.
