Legally, a small claims lawsuit begins with a form provided by the judiciary. This free, downloadable PDF form necessitates manual completion and attachment of supporting documents. Besides being outdated and aesthetically unappealing, its generalized fields often fail to adequately describe the case.
For example, the “Claim Description” section requires details of when “the obligation to pay the claimed sum arose, whether by agreement or otherwise.”
This is irrelevant to most small claims, such as spam, travel, or traffic accident claims.
The majority of fields present similar challenges, potentially leading to convoluted descriptions and misrepresentation of claims.
Furthermore, manually completing paper forms is outdated and inferior to digitally creating a structured document using a computer or mobile device.
Small Claims Lawyer
Using a lawyer is an alternative, but often uneconomical or unnecessary for simple, low-value claims, particularly when the claimant understands their case.
However, for complex cases or high claim values, consultation with a lawyer is recommended. Nonetheless, this option is expensive relative to the average small claims value.

Note that representation by a lawyer in small claims court is prohibited unless special permission is granted (approximately 1% of cases).
