Where to file a small claims lawsuit? A small claims court lawsuit must be filed in a Small Claims Court located within the judicial district meeting one or more of the following criteria:
- The defendant’s residence;
- The defendant’s place of business;
- The location where the act or omission giving rise to the claim occurred;
- In claims concerning online commerce or publication (e.g., online product purchase or online defamation), the lawsuit may also be filed in the plaintiff’s (not the defendant’s) place of residence or business.
- A counterclaim must be filed in the same court as the original claim.
For example: I was involved in a car accident in Netanya and the insurance company I am suing is located in Ashkelon. I may file the lawsuit in any Small Claims Court in the Central District (as Netanya, which is in the Central District, is the location where the act giving rise to the claim occurred), or in any Small Claims Court in the Southern District (as Ashkelon is located in the Southern District and is the place of business of the defendant insurance company).
